Consumer Product Safety Enforcement Trends: The Resurgence of Administrative Litigation and Heightened Stakes in Civil Penalty Settlement Negotiations at the CPSC

September 12, 2013
12:00 – 1:00 pm EST

Having just completed a regulatory transformation following the passage of the Consumer Product Safety Improvement Act in 2008, the US Consumer Product Safety Commission (CPSC) has reasserted itself in the enforcement of the nation’s consumer product safety laws – as shown by recent CPSC enforcement actions making headlines:

  • Federal judge sentences the president of LM Import-Export Inc. to 22 months in prison for violating consumer product safety laws
  • CPSC files first series of administrative complaints in over 11 years
  • CEO of Maxfield & Oberton sued by CPSC in his individual capacity after company dissolution
  • Kolcraft, Williams-Sonoma, and Ross agree to comprehensive and ongoing compliance programs in addition to monetary penalties in recent civil penalty settlements with CPSC

CPSC Commissioner Robert Adler will join Mintz Levin’s Consumer Product Safety Practice to discuss the current trajectory of enforcement trends and proactive steps your company can take to prevent becoming the subject of these types of enforcement actions.
